Serious Motorcycle Accident Turns to Wrongful Death

Serious Motorcycle Accident Turns to Wrongful Death

Serious Motorcycle Accident Turns to Wrongful DeathA serious motorcycle accident turned to wrongful death after the rider died shortly after the collision. The motorcycle accident occurred near Kettle Falls at the intersection of U.S. Highway 395 and state Route 20. Authorities say a dump truck crossed into the motorcyclist lane of travel and caused the collision. The motorcyclist was taken to a nearby medical center with serious injuries. However, the motorcyclist, unfortunately, died later from the severity of injuries suffered in the crash. It is unknown if any drugs or alcohol played a factor in this crash according to a news release from Washington State Patrol. The roadway was closed for several hours following the motorcycle accident while crews worked to clear the accident and gather evidence.

Wrongful Death Claim

When a person is killed due to the negligence of another, including in a car accident, the surviving members of the victim’s family may file a wrongful death claim. Each state legislature has enacted wrongful death statutes that govern who can bring a wrongful death claim. Usually, immediate family members of the deceased seek a wrongful death claim to compensate for financial and emotional damage.

Why Do I Need to Hire a Wrongful Death Attorney?

Losing a loved one can often bring a lot of stress and turmoil to family members. Working with a wrongful death attorney can help take away some of the stress and burden. Your attorney will work hard to help the family receive the financial compensation they deserve.

Wrongful death suits can be filed against an individual or a corporation. For example, if a person was killed in a semi truck accident caused by the negligence of the semi truck driver, a wrongful death suit can be brought against the semi trucking company. When such negligence occurs, the responsible party is liable to provide compensation for the death of the victim. An experienced wrongful death attorney will fight to compensate the loss of the victim’s medical expenses, funeral expenses, pain and suffering, future wages, court fees, lawyer fees, and any other related expenses.

Typically, benefits are paid out to the victim’s closest relative such as a spouse, child, or parent. Your wrongful death attorney will work with you to ensure your family receives the full value they are entitled to.

Are Motorcycle Accidents More Common than Car Accidents?

Are Motorcycle Accidents More Common than Car Accidents?

Motorcycle Accidents VS Car AccidentsDue to a motorcycle’s lack of protection to the rider, a person may assume that more motorcycle accidents are common. But which is most common, motorcycle accidents or car accidents? According to statistics from the National Highway Traffic Safety Administration (NHTSA), in 2013, about 106,000 motorcycle accidents occurred compared to 5,669,000 car accidents. In addition, 4,668 people died in a motorcycle accident while 22,383 in a car accident. Thus, there are far more car accidents than motorcycle accidents.

However, according to motorcycle accident statistics, per vehicle mile traveled, a motorcyclist was 26 times more likely to be killed in a motorcycle accident than a driver or passenger in a car accident. Similarly, a motorcyclist is five times more likely to be injured in an accident than a passenger in an automobile.

Motorcycle Accidents vs. Car Accidents

  • Approximately 80 percent of motorcycle accidents involve injury or death while only 20 percent of car accidents involve injuries or fatality.
  • There are 22.92 motorcycle fatalities for every 100 million miles traveled. In contrast, there are 0.86 fatal car accidents per 100 million miles traveled.
  • Of all registered vehicles, motorcycles make up 3 percent and .07 percent of vehicle miles traveled. However, motorcycles make up 14 percent of all traffic fatalities.
  • Failure to see a motorcycle is the most common cause of a motorcycle accident.
  • Three-fourths of all motorcycle accidents involve a collision with another vehicle, most commonly a passenger vehicle.

High Death Rate of Motorcycle Accidents

While there are more car accidents on American roads, motorcycle accidents are substantially more fatal; especially for motorcyclists that are not wearing a helmet at the time of the accident. 37 percent of fatal motorcycle accidents could be prevented had the rider been wearing a helmet. An additional, 67 percent could have avoided injury by wearing a helmet.

Motorcyclist lack protection and often result in a wide range of injuries including minor cuts to life-threatening injuries that can alter a person’s life forever such as paralyzed or vegetative state.

When to Hire a Motorcycle Accident Lawyer

When to Hire a Motorcycle Accident Lawyer

When to Hire a Motorcycle Accident LawyerIf you’ve been injured in a motorcycle accident you may be wondering if or when to hire a motorcycle accident lawyer. Motorcycle accidents typically involve more serious injuries or even deaths than car accidents. In fact, the number of motorcycle accident deaths is about 27 times more than car accident deaths according to data collected by the US Insurance Institute for Highway Safety (IIHS).

If you are wondering when it is necessary to hire a motorcycle accident lawyer, read on to help you make some important decisions.

Motorcycle Accidents That May Not Need a Lawyer

Not every motorcycle accident necessarily requires the help of a lawyer. You may be able to handle the claim yourself if the following elements are true.

  • You were not injured in the accident.
  • You are at fault for the accident.
  • Only minor damages to your motorcycle occurred.
  • No one else was hurt in the motorcycle accident.

When to Hire a Motorcycle Accident Lawyer

If the motorcycle accident was caused by a negligent driver and you are suffering from serious injuries, you need to hire a motorcycle accident lawyer. The following are some good reasons to hire a motorcycle accident lawyer.

Serious Injuries Were Incurred from the Accident

A motorcycle accident that left serious injuries will likely need a motorcycle accident lawyer to handle the case to receive the most compensation. An experienced motorcycle accident lawyer will be able to receive compensation for things such as medical expenses, pain, and suffering, out of pocket costs and other related damages.

If the Insurance Company is Refusing to Pay

Sometimes an insurance company may refuse to pay for various reasons. Or the insurer may be offering a low settlement that is unacceptable. Should this happen to you, an experienced trusted attorney at Parke Gordon Law Firm will fight to get you every penny you deserve for your motorcycle accident case. We will fight for your rights and negotiate until the insurer will pay a fair settlement.

The Other Party is at Fault

When you have been injured in an accident caused by someone else, you need a good personal injury attorney on your side to fight for you. An attorney will help you with the legal matters to make sure you are receiving the compensation you deserve. The at-fault party will be required by the court to pay for all damages if found guilty. A motorcycle accident lawyer at Parke Gordon Law Firm will help to protect your rights in and out of court and make sure you are fully compensated.

Disputed Liability

Sometimes the at-fault party will not accept responsibility. In addition, sometimes the insurer of the at-fault party may defend their policyholder to avoid paying the claim. If this is the case, hiring a motorcycle accident attorney will be in your best interest. Your attorney will argue your case with experience and prove the other party to be at-fault with evidence gathered from the accident. The lawyer can then either compel the insurance company to pay for the damages or take the case to trial.

Coeur d’Alene Resident Involved in Fatal Motorcycle Accident

Coeur d’Alene Resident Involved in Fatal Motorcycle Accident

Coeur d’Alene Resident Involved in Fatal Motorcycle AccidentA Coeur d’Alene resident was recently involved in a fatal motorcycle accident that occurred in Wyoming. Officials say the motorcycle accident occurred on U.S. 16 near Moorcroft. The driver of the motorcycle was heading westbound when it entered the eastbound lane and collided head-on with an oncoming car. The motorcycle crashed into a barrow ditch where it was engulfed in flames. Both the driver of the motorcycle and the car died at the scene of the accident.

Motorcyclist Fatalities

In 2017, nearly 5,000 fatal motorcycle accidents occurred. Though tragic, that is almost 300 less than in 2016. However, fatal motorcycle accidents occur much more frequently than any other traffic death. In fact, motorcycle fatalities occur 28 times more often than those of passenger vehicle occupants, based on per mile traveled. All of these statistics are reports released by the Governors Highway Safety Association (GHSA).

“Motorcyclist fatality number has fluctuated from year to year over the past decade, so while we are cautiously optimistic about this projection, we really need to see a sustained trend downward toward eventually eliminating motorcyclist fatalities altogether,” said Tara Casanova Powell, author of “Motorcyclist Traffic Fatalities by State.”

The figures mentioned above are projections based on preliminary data provided for 2017 from all 50 states in America and the District of Columbia. 2017 compared with 2016, motorcycle fatalities have decreased in 30 states, remained the same in two states, and increased in 18 states.
