Wrongful Death of Passenger from Driver Running a Stop Sign

Wrongful Death of Passenger from Driver Running a Stop Sign

Wrongful Death of Passenger from Driver Running a Stop SignIdaho State Police reported a passenger wrongful death from the driver of another vehicle running a stop sign in Coeur d’Alene. The driver of a black SUV was traveling eastbound on Boekel Road when he failed to stop at the stop sign. A minivan was traveling northbound on US95 when it collided with the SUV. The passenger of the SUV was ejected from the vehicle and pronounced deceased at the scene of the car accident. All occupants of both vehicles were reportedly wearing seatbelts at the time of the crash. The driver and three other passengers in the SUV were taken to a nearby medical center for evaluation of injuries. Police suspect alcohol may have been a factor in this accident. The investigation is ongoing.

Passenger Wrongful Death Claim

When a passenger is injured or dies from the negligence of a driver, a wrongful death case can be filed against the negligent driver. In the car accident mentioned above, the passenger was not at fault for the driver speeding. Surviving family members can then bring forth what is known as a wrongful death case.

Wrongful Death

Wrongful death is a legal term to describe a claim that certain individuals can make against a person who wrongfully or negligently causes the death of another. Wrongful death claims are enacted by the state legislature to govern who can bring a wrongful death claim.

A wrongful death lawsuit allows the victim’s family to seek out compensation any financial losses acquired as a result of the death. Wrongful death is also a way the family can seek justice against the negligent party.

How is a Fatality Crash is a Wrongful Death Case?

The following are some scenarios in which filing a wrongful death case would be applicable.

Car Accident

Many wrongful death cases are filed after a fatal car accident. There are many ways the other driver can be found negligent for the victim’s death following a car accident. For instance, a distracted driver who caused a car crash can be held responsible for their negligent behavior through a wrongful death case if they killed the other driver. Anyone operating a motor vehicle is under oath to act responsibly and drive safely. When a negligent driver chose to do otherwise and harms another, they should be held accountable.

Driving Under the Influence

A driver under the influence of drugs or alcohol is a prime candidate for being held responsible for a fatality. Clearly, it is easy to see the negligence of a drunk driver.

Premises Liability

Incidents such as a slip and fall accident where the owner of the property should have known of the hazardous circumstances that caused a death make the owner liable of negligence. It is rare for a person to die from a slip and fall accident or other common premise liability scenarios. However, situations such as an accidental drowning, also fall under this category.

Tips for Hiring a Wrongful Death Attorney

Tips for Hiring a Wrongful Death Attorney

Tips for Hiring a Wrongful Death AttorneyAfter a fatal car accident, motorcycle accident, truck accident or other motor vehicle accident you may be wondering how to hire a wrongful death attorney. If you’ve had to suffer the death of a loved one due to the negligence of another driver, you can file a wrongful death suit on his or her behalf to receive justice.

Why Hire a Wrongful Death Attorney

Losing a loved one can often bring a lot of stress and turmoil to family members. Working with a wrongful death attorney can help take away some of the stress and burden. Your attorney will work hard to help the family receive the financial compensation they deserve.

Wrongful death suits can be filed against an individual or a corporation. For example, if a person was killed in a semi truck accident caused by the negligence of the semi truck driver, a wrongful death suit can be brought against the semi trucking company. When such negligence occurs, the responsible party is liable to provide compensation for the death of the victim. An experienced wrongful death attorney will fight to compensate the loss of the victim’s medical expenses, funeral expenses, pain and suffering, future wages, court fees, lawyer fees, and any other related expenses.

Typically, benefits are paid out to the victim’s closest relative such as a spouse, child, or parent. Your wrongful death attorney will work with you to ensure your family receives the full value they are entitled to.

What to Look For When Hiring a Wrongful Death Attorney

Here are a few things to look for when hiring a wrongful death attorney.

  • How much experience does he or she have as a wrongful death attorney in the specific area of your case? For example, if your family member died in a car accident, you’ll want an experienced car accident lawyer who can handle your wrongful death suit.
  • Who will be working on your case? At Parke Gordon, your assigned wrongful death attorney will handle the majority of your case. However, staff members will also be helping to gather any medical bills or other parts of the case to ensure all things are in proper order.
  • What do online Google reviews say about this lawyer?
  • Are there any disciplinary actions against this lawyer? You can check the relevant state bar association website.

Wrongful Death Accident Caused by DUI Driver

Wrongful Death Accident Caused by DUI Driver

Wrongful Death Accident Caused by DUI DriverWashington State Patrol reported a wrongful death accident caused by a DUI driver. A former Fairchild airman was killed in a car accident when a drunk driver struck his vehicle from behind causing it to spin unexpectedly into oncoming traffic. He was then hit again by another vehicle. Police say the drunk driver had an outstanding warrant for a DUI hit and run and could not remember the details leading to this wrongful death accident. The drunk driver was arrested with his third DUI charge. He also has had two felonies, 15 misdemeanors and 11 failures to appear. The twin brother of the deceased posted on Facebook saying he is angry about his brother’s death but doesn’t want that to be mistaken for hate towards the drunk driver.

Wrongful Death Overview

Wrongful death occurs when someone is killed due to another person’s negligence or misconduct. For example, when a drunk driver kills another driver, a wrongful death case may be filed by the surviving family members of the deceased. Keep in mind a criminal prosecution may be related to the fatality but a wrongful death lawsuit is a civil action that is separate from any criminal charges. The standard of proof is lower in a civil case than it is in a criminal case.

Who Can Bring a Wrongful Death Case

A wrongful death lawsuit depends largely on the state in which the accident took place. Each state legislature has enacted wrongful death statues that govern who can bring a wrongful death claim. In all states, spouses, children, and parents of unmarried children are able to file a wrongful death case. In some states, others such as putative spouses or financial dependents can also recover damages. In addition, some states allow siblings and grandparents to bring a claim. Contact the experienced wrongful death attorneys of Parke Gordon Law Firm in Spokane to see if you have a good wrongful death case.

What Types of Damages Can Be Recovered in a Wrongful Death Case?

A lawsuit for wrongful death may recover both economic and noneconomic damages to be distributed to eligible family members or dependents.

Economic damages may include the following.

  • Medical and funeral expenses
  • Out-of-pocket expenses
  • Lost household
  • Loss of support and income
  • Lost prospect of inheritance

Noneconomic damages such as pain and suffering may also be recoverable. The award for damages will include interest starting from the date of death.

If a Pedestrian is Killed While Jaywalking

If a Pedestrian is Killed While Jaywalking

If a Pedestrian is Killed While JaywalkingIf a pedestrian is killed while jaywalking across a busy road or highway, is the driver at fault? In the United States, drivers are required by law in most states to “exercise due care.” That means a driver is to make every possible attempt to avoid hitting a pedestrian.

If a Pedestrian is Killed While Jaywalking

While it depends on the situation, if a pedestrian is killed while crossing a busy road in an unexpected area (or jaywalking), it is likely the driver will not face charges. However, if the pedestrian is in a designated crosswalk, the driver could face criminal charges for vehicular or negligent homicide as well as wrongful death charges from the surviving party of the pedestrian.

Unless the driver is obviously driving under the influence of drugs or alcohol, they probably would not be immediately arrested at the time of the accident. A police officer may detain the driver to obtain a blood or urine test to help determine if drugs or alcohol were involved. However, the driver may refuse and only face administrative penalties.

Is the Jaywalker or Driver at Fault by Law?

A jaywalker is anyone crossing the street outside of designated areas or crosswalks. If a jaywalker is hit while crossing the street, who is at fault? The pedestrian is partly at fault for breaking the law by jaywalking. However, the driver may also be partly at fault depending on the circumstances. The court system will use what is known as “comparative fault.”

Regardless of who is at fault, all parties are responsible to be aware of their surroundings. Avoid distracted driving or walking by putting away your cell phone and concentrating on the road.

Recoverable Damages in a Wrongful Death Claim

Recoverable Damages in a Wrongful Death Claim

Recoverable Damages in a Wrongful Death ClaimSpokane wrongful death attorneys at Parke Gordon Law Firm have years of experience handling wrongful death cases. What is a wrongful death? Wrongful death is a legal term to describe a claim that certain individuals can make against a person who wrongfully or negligently causes the death of another. Each state legislature has enacted wrongful death statutes that govern who can bring a wrongful death claim. There are some recoverable damages in a wrongful death claim described as follows.

Recoverable Damages in a Wrongful Death Claim

There are three types of damages in a wrongful death claim that are often recovered: (1) economic (2) non-economic, and (3) punitive.

Economic Damages

Economic damages of a wrongful death claim include the value of financial contributions. For example, how much money would the victim have made to provide for his or her family had they not died. Other economic damages include the following.

  • Loss of benefits such as health insurance coverage or pension plans.
  • Services that the victim would have provided.
  • Loss of the victim’s expected earnings.
  • Loss of inheritance caused by an untimely death.
  • Medical and funeral expenses in coordination to the death.

Non-economic Damages

Non-economic damages are less tangible than economic damages. Non-economic damages, however, often have more value than economic damages. Examples of non-econmic damages include the following.

  • Loss of love, companionship, and society from the deceased.
  • Loss of consortium.
  • Loss of protection, guidance, nurturing, advice, care, etc.
  • Damages for the survivors’ mental health, anguish, pain and suffering.

Punitive Damages

In extreme cases, punitive damages are awarded to punish the defendant for, especially bad conduct. Many states do not award punitive damages for wrongful death lawsuits or these damages are not recoverable against certain defendants including most governmental agencies.

Facts About Head-on Collisions

Facts About Head-on Collisions

Facts About Head-on CollisionsAll drivers are educated and trained to drive safely. Furthermore, many vehicles are now equipped with technology intended to make traveling in a motor vehicle safer. However, these things do not save Parke Gordon clients from negligent drivers. There are still many who choose to drive fatigued, distracted or even drunk. Such actions make it risky to drive and often lead to serious car crashes such as head-on collisions. 18 percent of all fatal car accidents are from a head-on collision according to statistics found by the Fatal Analysis Reporting system. Here are some important facts about head-on collisions.

Facts About Head-on Collisions

A head-on collision typically occurs when a car crosses over the centerline of the roadway or a median in an attempt to pass but collides with an oncoming vehicle from the other direction. Another common reason for head-on collisions is from a wrong way driver. 75 percent of all head-on collisions happen on two-lane rural roads. This high rate of head-on collisions on rural roads indicates that these crashes are usually due to a failed passing maneuver. Head-on collisions are often serious and lead to many wrongful deaths. Other negligent acts that lead to a head-on collision include:

  • Falling asleep while driving.
  • Driving under the influence of drugs or alcohol.
  • Driving distracted (i.e. using a mobile device while driving).
  • Losing control of the vehicle.
  • Road conditions.
